This contract is made this 30th day of November, 2003, between the Press-Telegram, a division of Garden State Newspapers Inc., a corporation, hereinafter known as the Employer, and the Southern California Media Guild, a Local (#39069) chartered by The Newspaper Guild - Communications Workers of America (AFL-CIO, CLC) hereinafter known as the Guild, for itself and on behalf of all employees of the Employer described in
Article I.
ARTICLE 1 - COVERAGE
1. This contract covers all employees of the Employer in the following departments, except as provided in Section 2: editorial, circulation, customer service, PBX and maintenance operation departments engaged in the publication and delivery of the Long Beach Press-Telegram at Long Beach, California and wherever else such functions on behalf of the Press-Telegram are performed.
2. (a) Excluded from the provisions of the contract are:
Editorial: Associate Editor, Assistant to the Editor, Business Editor, City Editor Night, City Editor Day, Assistant to the Executive Editor/Confidential Secretary, 1 Confidential Secretary, Design Editor, Editorial Pages Editor, Features Editor, Executive Editor/Sr. VP, Executive News Editor, Features Editor, Managing Editor, News Editor, Photo Director, Senior Editor/Sports/Photo, Sports Editor, Building Manager.
Circulation: Circulation Director, 2 Confidential Secretaries, Circulation Promotions Manager, Home Delivery Manager, 4 Regional Home Delivery Managers, Single Copy Sales Manager, NIE Coordinator.
(b) Should the Publisher create a new or additional Supervisorial/Managerial position during the term of this Agreement, a written communication to the Guild that identifies such position(s) and provides information relative to the Supervisorial/Managerial responsibilities and an opportunity to discuss the position(s) will be afforded to the Union at least one week prior to the creation of the position(s).
3. Performance of the following, whether by presently or normally used processes or equipment or by new or modified processes or equipment, shall be assigned only to employees covered by this contract:
(a) The kind of work either normally or presently performed within the unit covered by this contract,
(b) Any other kind of work assigned to be performed within said unit.
4. (a) If necessary for the efficient operation of the newspaper, supervisors may perform a limited amount of bargaining unit work, however such work shall not be routinely performed and shall not cause the loss of a bargaining unit position or potential position.
(b) A supervisor may temporarily assign an employee to work on projects initiated by and with coordination by an affiliated newspaper or enterprise so long as the nature of the assigned work is judged by the supervisor to be within the abilities of the employee. Any employee may decline such an assignment unless no other competent employee is available.
